Last updated: 1 July 2025
These Terms of Service (“Terms”) apply to all services provided by Looking Fine Pty Ltd (ABN 70 703 559 611) of Melbourne VIC, including all professional business and consulting services described on this website. By engaging our services, requesting a quote, or using this website, you agree to be bound by these Terms.
1. Our Services
Looking Fine Pty Ltd provides professional business and consulting services, including business advisory, strategy development, operational reviews, and related support services. The specific scope, deliverables, timeline and fees for any engagement will be set out in a written proposal, statement of work or engagement letter agreed between you and us before work commences.
2. Quotes and Engagement
Quotes provided by us are valid for 30 days from the date of issue unless otherwise stated in writing. A quote does not constitute a binding agreement until accepted by you and confirmed by us in writing. Work will commence only after written acceptance of the agreed scope and fees.
3. Fees and Payment
Fees are charged in accordance with the agreed proposal or engagement letter. Unless otherwise agreed in writing, invoices are payable within 14 days of the invoice date. Late payments may attract interest or reasonable recovery costs as permitted by law. All fees are quoted in Australian dollars (AUD) and, unless stated otherwise, are exclusive of GST, which will be added where applicable.
4. Your Responsibilities
You agree to provide accurate, complete and timely information reasonably required for us to perform the services, to respond to requests in a timely manner, and to ensure that any information you provide to us does not infringe the rights of any third party or breach any law.
5. Confidentiality and Privacy
We treat information you provide to us as confidential and will not disclose it to third parties except as required to perform the services, with your consent, or as required by law. Our handling of personal information is described in our Privacy Policy.
6. Intellectual Property
You retain ownership of materials you provide to us. Upon full payment of our fees, you receive a licence to use the deliverables we prepare for you for your internal business purposes. We retain ownership of our pre-existing methodologies, templates, frameworks and know-how.
7. Limitation of Liability
To the fullest extent permitted by law, our liability arising out of or in connection with the services is limited to the fees paid by you for the relevant engagement. We are not liable for indirect, incidental or consequential losses, including loss of profit or business opportunity. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you may have under the Australian Consumer Law set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth) or any other applicable law that cannot lawfully be excluded.
8. Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your contract with us; you are also entitled to a refund for the reasonable value of the service not rendered, taking into account what has already been provided. For minor failures, we may, at our discretion, provide a remedy within a reasonable time, such as re-performing the affected part of the service or compensating you for the shortfall in value.
9. Termination
Either party may terminate an engagement by written notice in accordance with the notice period set out in the engagement letter, or immediately if the other party commits a serious and unremedied breach of these Terms. You remain liable for fees for work performed up to the date of termination.
